The Essence of Mediation

Mediation implies “amicable settlement” and signifies a form of

  • out of court,
  • confidential and
  • structured

dispute resolution; an alternative to litigation.

Mediation is based on the idea that the parties involved

  • know their situation better than any third party;
  • are consequently born to judge whether and which solution best meets their interests;
  • but are unable to reach an agreement because they are trapped in their dispute.

It is the – neutral – mediator’s major task to trigger and moderate the parties’ communication process.
