Mediation implies “amicable settlement” and signifies a form of
- out of court,
- confidential and
- structured
dispute resolution; an alternative to litigation.
Mediation is based on the idea that the parties involved
- know their situation better than any third party;
- are consequently born to judge whether and which solution best meets their interests;
- but are unable to reach an agreement because they are trapped in their dispute.
It is the – neutral – mediator’s major task to trigger and moderate the parties’ communication process.
